Medical marijuana was legalized in Florida in 2016 by a vote of 71% to 29%. A comprehensive survey conducted by the University of South Florida and Florida Atlantic University revealed strong support for marijuana policies in Florida. While 83% of respondents supported medical marijuana, over 60% expressed their support for the potential full legalization of adult-use cannabis, which is expected to appear on the 2024 ballot despite opposition from Florida’s Attorney General, who questions its federal legality.
The Smart & Safe Florida marijuana legalization initiative seeks to allow adults aged 21 and older to purchase and possess up to three ounces of cannabis for personal use, with a cap of five grams for marijuana concentrates.
Medical cannabis dispensaries could expand their operations to serve adults for personal use.
While the legislature would be authorized to approve additional entities beyond currently licensed dispensaries, the initiative does not mandate it, and there are no provisions for home cultivation, expungement of prior records, or social equity.
Meanwhile, Florida’s Sanctuary Cannabis has filed a lawsuit against the state, challenging the significant increase in the biennial medical marijuana licensing fee, which soared from $60,000 to $1.33 million.
